By Monday, parliament must submit to the Constitutional Court the decision to dismiss Ilir Meta from the post of president of the republic.
This is the first case in 3 decades that constitutional judges will decide the fate of the head of state, as despite the clashes of each majority with the presidents, no majority had 94 votes and the idea of dismissal has never crossed the line of political statements.
According to the law of the Constitutional Court, its members have 3 months to decide whether the dismissal of Ilir Meta passes or not to be considered in the plenary session.
And if we look at this deadline from the point of view that August is a holiday and is not calculated, then the judges have until October 14 to decide whether or not to pass the Meta case in the plenary session.
During this period the president and the assembly prepare to defend their positions before the judges, but on the other hand the constitutional court itself is expected to undergo changes by the fall.
Currently the Constitution has 7 members; 3 elected by the president, 3 by the assembly, and Vitore Tusha whose mandate has ended.
But by September the high court is expected to have 10 members and be able to elect 3 judges to the Constitutional Court.
If this happens then the issue of dismissal of the President of the Republic will be tried by a panel of 9 judges.
According to the law on the Constitutional Court, decisions are taken by 5 votes and it remains to be seen whether the parliament will convince the judges whether or not the president has seriously violated the Constitution of the Republic of Albania.
